Our Services display some content that is not InvestorX’s, such as documents published by public companies, mutual (investment) funds and third party filers. This content is the sole responsibility of the entity that makes it available.
You may need an InvestorX account in order to use some of our Services. To protect your account, keep your password confidential. You are responsible for the activity that happens on or through your account. Try not to reuse your account password on third-party applications. InvestorX is a licensed user of information from a variety of third-party sources including SEDAR and stock exchanges.
If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify InvestorX and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.
You are permitted to interact with the InvestorX Web Site on an individual basis using "web browser" or equivalent software only. The use of automation software or any other mechanism to download information in bulk, or make excessive or repetitive requests, from the InvestorX Web Site without the written permission of InvestorX is not allowed.
InvestorX Web Site is provided "as-is" and is operated on a "best efforts" basis. You are advised that any information displayed on the InvestorX Web Site may or may not be accurate, timely, relevant, or appropriate. You are further advised that the InvestorX Web Site is subject to service outages without prior notice. InvestorX Incorporated makes no warranties or representations, whatsoever, either express or implied, including without limitation any warranties with respect to information accuracy, information timeliness, service availability, merchantability, or fitness for a particular purpose.
You agree to assume all risk in using the InvestorX Web Site. InvestorX Incorporated and its information providers are not liable for any direct, indirect, special, exemplary, punitive, or consequential damages, including lost profits, or any other circumstance arising from your use of the InvestorX Web Site, whether or not advised of such a possibility.
InvestorX Web Site does not represent, advise or recommend the buying or selling of any security.
You may cancel your monthly InvestorX subscription at any time upon request. When you cancel your monthly (or yearly) InvestorX subscription you are responsible for all charges incurred up to the end of the period (month or year depending on subscription type). InvestorX bills at the beginning of each pay period . You are advised to check your credit card statements, following your final payment, to confirm that further automatic payments have ceased as expected. Cancellation errors are considered billing errors and are subject to the InvestorX Refund Policy.
All sales are final. All InvestorX charges are non-refundable except over-charges due to billing or payment errors. InvestorX invoices may include subscription fees and other charges. You are advised to examine your InvestorX invoices and corresponding credit card transactions. If you suspect you have been over-charged due to a billing or payment error, you must request a refund within ninety (90) days of the corresponding billing or payment date.
The InvestorX Web Site contains links to many other web sites. InvestorX is not responsible for the content, policies, or any other aspect of such web sites.
We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether. You can stop using our Services at any time, although we’ll be sorry to see you go. InvestorX may also stop providing Services to you, or add or create new limits to our Services at any time.
We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.
If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.
These terms control the relationship between InvestorX and you. They do not create any third party beneficiary rights.
If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).
If it turns out that a particular term is not enforceable, this will not affect any other terms.
The laws of Ontario, Canada will apply to any disputes arising out of or relating to these terms or the Services. All claims arising out of or relating to these terms or the Services will be litigated exclusively in the federal or state courts of Ontario, Canada, and you and InvestorX consent to personal jurisdiction in those courts.
